What process did the neighbors use to get the permit issued by the building department challenged? Isn't the building commission the zoning enforcement officer? Your statements seem to indicate the homeowner was at fault for asking for and getting a building permit.
It appears that the authority issuing the building permit issued it in error. You never said if the garage variance was written in such a way as to prevent any other alteration, additions or modifications to the sstructure.
